1. Introduction
Welcome to Ekatra, operated by Ekatra Technology Corporation ("Ekatra," "we," "our," or "us"), a proprietorship registered in India. These Terms of Service ("Terms") govern your access to and use of the Ekatra platform, website, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.
Ekatra operates as India's first group buying platform for automotive products, facilitating connections between customers and authorized dealers and manufacturers (where applicable). We enable customers to leverage collective buying power to negotiate better prices and participate in exclusive group deals.
If you do not agree to these Terms, please do not use our Platform.
2. Definitions
"Products" refers to vehicles (including cars, motorcycles, and electric vehicles), automotive accessories, extended warranties, insurance products, and related services offered through the Platform.
"Customer" refers to any individual or entity using the Platform to browse, negotiate, or purchase Products.
"Dealer" refers to authorized vehicle dealers or dealer groups partnered with Ekatra.
"Manufacturer" refers to vehicle manufacturers or original equipment manufacturers (OEMs) who may partner with Ekatra (where applicable).
"Partner" refers to dealers, manufacturers, or other entities providing Products or services through the Platform.
"Group Deal" refers to collective buying opportunities where multiple customers can join together to purchase Products at discounted prices.
"Offer" refers to a price proposal submitted by a customer for a specific Product.
3. Eligibility
To use our Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Be a resident of India
- Provide accurate and complete registration information
- Maintain the security of your account credentials
4. Platform Services
4.1 Service Description
Ekatra provides a technology platform that connects customers with dealers and manufacturers (where applicable). Our services include:
- Product browsing and search functionality
- Group buying opportunities and deals
- Price negotiation and offer submission
- Partner location information and availability
- Communication facilitation between customers and Partners
4.2 Platform Role
Ekatra acts solely as an intermediary platform. We do not:
- Own, sell, or manufacture Products
- Act as a dealer, manufacturer, or agent for any party
- Guarantee the availability, quality, or condition of any Product
- Control pricing decisions made by dealers or manufacturers
- Handle physical delivery or logistics of Products
5. Group Deals
5.1 Participation
Group Deals allow multiple customers to collectively purchase Products at special pricing. By participating in a Group Deal, you acknowledge that:
- Pricing and availability are subject to minimum group size requirements
- The deal may be cancelled if minimum participation is not met
- Delivery timelines may vary based on group coordination
- Specific terms and conditions apply to each individual deal
5.2 Commitment
When you join a Group Deal, you make a non-binding expression of interest. Final purchase commitment occurs only when you sign an agreement directly with the dealer and make the required payment.
6. Offers and Negotiations
6.1 Making Offers
Customers may submit price offers for Products. By submitting an offer, you:
- Confirm your serious intent to purchase if the offer is accepted
- Provide accurate contact and financial information
- Agree to respond promptly to communications from Ekatra and/or Partners
- Understand that Partners may contact you directly or through Ekatra
- Understand that offers are subject to Partner acceptance
6.2 Offer Acceptance
Partners have sole discretion to accept, reject, or counter any offer.
Acceptance Process:
- Ekatra will notify you of the Partner's response through the Platform
- Acceptance may be communicated by Ekatra on behalf of the Partner
- Final binding agreement is between you and the Partner
- Ekatra acts solely as a facilitator and communication platform
- Acceptance constitutes an agreement to proceed with the transaction, subject to final documentation and payment
7. Pricing and Payments
7.1 Pricing Information
All prices displayed on the Platform are provided by our Partners and are indicative only. Pricing may vary based on:
- Product category and specifications
- Location and delivery charges
- Applicable taxes and regulatory fees
- Insurance and warranty options
- Additional services or accessories
Prices are subject to change without notice. Final pricing will be confirmed in your purchase agreement with the Partner.
7.1a Product-Specific Pricing Terms
Certain product categories have specific pricing considerations:
For Automotive Products - Vehicle Registration Type:
- Unless otherwise explicitly stated, all vehicle prices are quoted for PRIVATE (Individual) registration only
- Commercial registration prices are typically higher and will be quoted separately upon request
- Registration type affects RTO fees, road tax, insurance premiums, and loan eligibility
- You must inform the Partner if you require commercial registration
- Ekatra is not responsible for pricing errors related to registration type
Note: As we expand our product offerings, additional product-specific pricing terms may be added here.
7.2 Payment Processing
All payments for Products are made directly to the Partner. Ekatra does not process Product payments. Any platform fees or service charges will be clearly disclosed before collection.
8. User Responsibilities
As a user of the Platform, you agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your account credentials
- Use the Platform only for lawful purposes
- Not engage in fraudulent or deceptive practices
- Not interfere with the Platform's operation or security
- Not use automated systems to access the Platform without authorization
- Comply with all applicable laws and regulations
- Respect intellectual property rights
9. Cancellations and Refunds
Cancellation and refund policies are determined by the individual Partner. Ekatra does not control these policies. Please review the specific cancellation terms provided by the Partner before completing your purchase.

10. Disclaimers
10.1 Platform "As Is"
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
10.2 Third-Party Content
Product information, pricing, and availability are provided by our Partners. We do not verify or guarantee the accuracy of this information. Customers should verify all details directly with the Partner.
10.3 No Agency Relationship
Ekatra is not an agent, representative, or partner of any dealer or manufacturer. We do not have authority to bind any party to any agreement.
11. Limitation of Liability
To the maximum extent permitted by law, Ekatra and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Product quality, condition, or performance issues
- Partner actions or omissions
- Delivery delays or failures
- Disputes between customers and Partners
Our total liability shall not exceed the amount of fees you have paid to Ekatra in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ekatra and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another party
- Your purchase or use of any Product
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.
13.3 Informal Resolution
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@ekatraonline.com.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on the Platform
- Updating the "Last Updated" date
- Sending email notifications for significant changes
Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
15. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include:
- Violation of these Terms
- Fraudulent or illegal activity
- Requests from law enforcement
- Discontinuation of the Platform
Upon termination, your right to use the Platform will immediately cease.

17. Accounts and Membership
17.1 Account Creation
Users can browse the Ekatra Platform and access general information as guest users without registration. However, to book or purchase vehicles, participate in group deals, or submit offers, you must create an account.
17.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate, current, and complete information
- Updating your information to maintain its accuracy
- Notifying us immediately of any unauthorized access or security breaches
17.3 Account Termination
We reserve the right to suspend, disable, or delete your account if we determine that you have:
- Violated these Terms of Service
- Provided false or misleading information
- Engaged in fraudulent or illegal activities
- Conducted activities that may harm our reputation or other users
- Violated applicable laws and regulations
We may block your email address and IP address to prevent further registrations. We are not liable for any damages resulting from account suspension or termination.
17.4 Minors
Individuals below 18 years of age may view content on the Platform with parental or guardian consent. However, any individual below 18 years cannot make booking requests or purchase any Products on the Platform. The Platform is considered in use once it is loaded into your device's temporary or permanent memory.
18. Restrictions on Use
18.1 Intellectual Property
Ekatra holds exclusive ownership and rights to all information, content, audio, video, logos, trademarks, and materials present on this Platform. You agree not to:
- Reproduce, modify, create derivative works, or distribute any content without written consent
- Use our trademarks, logos, or branding without authorization
- Copy, scrape, or extract data from the Platform using automated tools
- Reverse engineer or attempt to access source code
You may download materials for personal, non-commercial use only, provided you retain all copyright and proprietary notices.
18.2 Prohibited Activities
You agree not to:
- Engage in any fraudulent, abusive, or illegal activities
- Attempt to compromise the security of any computer network or crack passwords
- Use the Platform to transmit viruses, malware, or harmful code
- Impersonate any person or entity, or falsely claim affiliation
- Harass, threaten, or harm other users or third parties
- Post or transmit unlawful, defamatory, obscene, or inflammatory content
- Use automated systems (bots, scrapers) to access the Platform without authorization
- Interfere with or disrupt the Platform's operation or servers
- Violate any applicable laws, regulations, or third-party rights
18.3 User Content
While Ekatra may periodically monitor user-generated content such as reviews, comments, or forum posts, we are not obligated to do so. We accept no responsibility for any content posted by users, including errors, defamatory statements, or inaccuracies. We will fully cooperate with law enforcement authorities regarding any illegal content.
19. Communication and DND Consent
By accessing or using the Ekatra Platform, you explicitly consent to receive communications from us and our partners (including dealers, financial institutions, and manufacturers) through various channels, including but not limited to:
- Phone calls (voice calls)
- SMS and text messages
- WhatsApp and other instant messaging applications
- Push notifications through our mobile app
This consent is granted regardless of whether your phone number is registered with the National Do Not Call Registry (NDNC) or listed on www.nccptrai.gov.in.
These communications may include:
- Transaction updates and confirmations
- Service-related notifications
- Promotional offers and deals
- Vehicle availability and pricing updates
- Group deal notifications
- Customer surveys and feedback requests
- Important policy or terms updates
You may opt out of promotional communications at any time by contacting support@ekatraonline.com or using the unsubscribe link in our emails. However, you cannot opt out of transactional or service-related communications that are necessary for your use of the Platform.
20. Force Majeure
Ekatra shall not be liable for any failure to perform its obligations under these Terms if such failure results from events beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, storms, pandemics, epidemics)
- War, terrorism, riots, or civil unrest
- Government actions, laws, regulations, or court orders
- Labor strikes or disputes
- Internet or telecommunications failures
- Power outages or infrastructure failures
- Supply chain disruptions or material shortages
- Actions or omissions of third parties (dealers, manufacturers, logistics providers)
In the event of a Force Majeure occurrence, our obligations under these Terms shall be suspended for the duration of such event. We will make reasonable efforts to minimize the impact and notify affected users as soon as practicable. Neither party shall be liable for any delays, damages, or failures resulting from Force Majeure events.
21. Assignment
You have a limited, personal, non-exclusive, non-transferable license to access and use the Platform for your personal and non-commercial use only.
You cannot assign, transfer, or delegate these Terms, any rights granted hereunder, or any obligations to any third party. Any attempted assignment, transfer, or delegation by you shall be void and of no effect.
Ekatra's rights and obligations under these Terms are freely assignable and transferable by Ekatra to any third party without your prior consent. This includes situations where:
- Ekatra's business is acquired or merged with another company
- Assets are transferred as part of a corporate reorganization
- The Platform is sold or licensed to a third party
In such events, Ekatra shall have the right to transfer your account and account information to the acquiring party, who will assume Ekatra's rights and obligations under these Terms.
22. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision to the extent permitted by law.
23. Waiver
No failure or delay by Ekatra in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.
Any waiver of any provision of these Terms must be in writing and signed by an authorized representative of Ekatra. A waiver of any breach or default under these Terms shall not constitute a waiver of any subsequent breach or default.
24. Grievance Redressal
In accordance with the Information Technology Act, 2000, and rules made thereunder, Ekatra has designated a Grievance Officer to address your concerns regarding these Terms of Service, privacy practices, or any other grievances related to the Platform.
